"The victim was driving behind Guazza when Guazza made a U-turn across Route 37. Police said Pierce ran into the left side of Guazza's Jeep.

Pierce, who lived on Columbia Drive in New Fairfield, was taken to Waterbury Hospital by helicopter after the accident. He was pronounced dead on arrival.

Russell said his client was driving slower than 5 mph during the collision, which he said would make it "awfully hard to be criminally negligent."

Guazza's ankle was badly injured, and he also received leg, head and hand injuries, Russell said.

Guazza's friend and passenger told police after the accident Guazza began yelling "Oh my God," over and over. The friend suffered minor injuries, police said. "
