God forbid they set precedent that you can sue a motorcyclist for coming along "unexpectedly". Then we'll all have to start riding expectedly.

I'd take the judge/jury/executioner gig for this one...although the executioner deal is a bit premature. Perhaps a good caning is all the litigant needs.

Seriously though, the reaction to the article is warranted, given our increasingly litigious culture. Perhaps there is more to the story than a simple three-paragraph blurb, but frivilous lawsuits by people there who generally feel entitled to huge unwarranted settlements have become the rule, rather than the exception. It's a real bummer.</p>

"Substantial rate of speed" = "I'm looking to cover my a$$".



The only reason this will fly is because it's civil court. If the motorcyclist was really speeding, that would have been a mitigating(?) factor in the accident he would have never pleaded no contest to the negligent homicide charge.

Shysters prosecute cases that they know are unwinnable simply so they can charge the greedy suckers like this guy for the hours. They deserve each other.

a HUGE part of a "perfectly legal, perfectly safe U-turn" is making sure you yield to oncoming traffic, by the very fact that he hit and killed a person, we know beyond a reasonable doubt that it was NOT a "perfectly legal, perfectly safe U-turn"
